1. Introduction

Welcome to PikFoto! These Terms and Conditions ("Terms") govern your use of our application, website, and related services ("Services"). By using our Services, you agree to be bound by these Terms. Please read them carefully.

2. Definitions

• User: Any individual who uses or accesses the PikFoto Services.

• Subscription Plan: Recurring photo print package purchased on a monthly or annual basis.

• Single Package: One-time photo print purchase.

• Account Credit: Store credit applied toward future purchases or subscriptions.

• Photo Cycle: The recurring 30-day period in which photos are submitted, printed, and shipped.

3. Eligibility and Account Registration

Users must be at least 13 years old to use PikFoto. Users under 18 must have permission from a legal guardian. You agree to provide accurate and complete information when registering and to keep your account information confidential.

4. User Obligations and Prohibited Conduct

You agree to use PikFoto in a lawful and respectful manner and not to:

• Use automated systems (e.g., bots, scrapers) to access or interact with the Service.

• Interfere with or disrupt the Service or servers.

• Engage in abusive, fraudulent, or harassing behavior.

• Reverse engineer, decompile, or tamper with the application or software.

5. Subscription, Billing, and Renewals

Your subscription will automatically renew every 30 days unless canceled before the next billing cycle. Annual plans renew every 12 months unless canceled prior. Payments are securely processed through third-party providers. Users are responsible for ensuring payment methods are current.

6. Order Processing and Editing Tools

Users are solely responsible for uploading, editing, and approving their photo submissions before the applicable deadlines:

• All edits, including framing, captions, and dates, must be completed by the User.

• Deadlines: For subscriptions, edits must be completed at least 2 days before printing begins; for single packages, before the production request is submitted.

• PikFoto does not guarantee modifications after the deadline.

7. Captions and User-Provided Text

PikFoto allows Users to include captions on photos. Users accept full responsibility for the accuracy and appropriateness of caption text. PikFoto does not review captions before printing. We reserve the right to:

• Modify caption style or design at any time.

• Disable the caption feature entirely with prior notice.

8. Photo Quality and Printing Standards

• Files with resolution under 150 DPI will not be printed to maintain minimum quality standards.

• Users are responsible for the quality and resolution of uploaded photos.

• Printed photos may have natural variations in color, size, or finish due to manufacturing and materials.

• PikFoto may change photo formats, dimensions, or characteristics, with or without pricing changes, provided Users are informed in advance.

9. Promotions, Referral Credits, and Discounts

• PikFoto may offer promotions, discount codes, and referral programs at our discretion.

• Credits earned through promotions are non-transferable and cannot be redeemed for cash.

• Referral credits for Monthly Plans apply to the subsequent billing cycle; for Loyalty Plans, credits apply upon package renewal.

• Misuse or fraudulent use of promotions may result in suspension or forfeiture of benefits.

10. Shipping, Delivery, and Production

• Subscription orders ship every 30 days from the subscription start date.

• Production begins after the edit deadline each cycle.

• Users with individual packages must manually request production via the app. PikFoto is not responsible for printing packages without proper user request.

11. Modifications to Services

PikFoto reserves the right to modify, suspend, or discontinue any part of the Service or features at any time. Major changes will be communicated to Users in advance when feasible.

12. Third-Party Services and Integrations

Our Services may include third-party integrations such as payment processors or analytics tools. Use of these services is subject to their own terms and conditions. PikFoto is not responsible for third-party service failures or issues.

13. Data Retention and Backup Responsibility

PikFoto does not guarantee permanent storage of uploaded photos or data. Users are encouraged to maintain their own backups of important content.

14. Force Majeure

PikFoto is not liable for delays or failures in performance caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, war, government actions, internet outages, or other unforeseeable events.

15. Intellectual Property Rights

All content, branding, software, and technology provided by PikFoto are owned by PikFoto or its licensors. Users may not copy, distribute, modify, or create derivative works without express written permission.

16. Termination

PikFoto reserves the right to suspend or terminate User accounts for violations of these Terms. Users may cancel subscriptions at any time through the app or website.

17. Limitation of Liability

To the fullest extent permitted by law, PikFoto is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services. Our total liability will not exceed the amount you paid in the 12 months preceding the claim.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida. Any disputes arising from these Terms will be resolved exclusively in the courts located in Miami, Florida.
